Terms of Service

Solberra is a multi-creator media-album marketplace for instructor-led classes: instructors (“creators”) upload class photos and videos and sell them to their students (“buyers”). Solberra is operated by Gavry LLC (“we”, “us”). By using the service you agree to these terms.

You must be at least 18 years old to create an account. Minors may appear in or receive purchased media only with the consent of a parent or guardian, and may use the service as buyers only with such consent.

You agree not to use Solberra to upload, sell, or distribute:

• adult or sexually explicit content;
• illegal content, or content that violates anyone’s rights;
• copyrighted or trademarked material you do not own or have the rights to;
• spam, malware, or material that harasses or abuses others.

As a creator, you represent that you own or have the necessary rights to all content you upload, that you price your albums honestly, and that you will comply with all applicable tax laws on your earnings. You are the merchant of record for your sales.

As a buyer, you agree to pay for what you purchase and not to redistribute, resell, or publicly post content you bought without the creator’s permission.

You agree not to use Solberra to commit fraud or abuse the service. This includes creating multiple accounts to game the referral program or other platform incentives, misrepresenting your identity or banking information, using unauthorized payment methods, initiating fraudulent chargebacks after receiving downloaded media, uploading content you do not have the rights to sell, or attempting to circumvent our platform fees. We may suspend or terminate accounts involved in suspected fraud, reverse related payments, and cooperate with law enforcement where appropriate.

Solberra facilitates transactions between creators and buyers; creators are the merchants of record. Payments are processed by Stripe Connect and are subject to Stripe’s terms. We collect a platform fee on each sale, disclosed at the point of sale.

Refunds are handled per our refund policy — a creator may issue a refund, and duplicate purchases of the same album are refunded automatically. Contact mgavr68@gmail.com with any payment questions.

We may remove content that violates these terms and may suspend or terminate accounts that do so. We aim to give notice where practical.

The service is provided “as is,” without warranties of any kind. To the fullest extent permitted by law, Gavry LLC is not liable for indirect, incidental, or consequential damages arising from your use of the service.

These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Dispute-resolution terms will be specified in the final, lawyer-reviewed version.
